Wildr Terms of Use

These Terms of Use (“Terms”) govern your access to and use of the Wildr website, mobile applications, and related services (collectively, the “Service”) operated by Wildr Platform LLC (“Wildr,” “we,” “our,” or “us”).
By creating an account or using the Service, you agree to these Terms. If you do not agree, you may not use the Service.
1. Description of the Service
Wildr is a digital platform designed to help homeowners, land stewards, and organizations support biodiversity through educational tools, plant information, habitat recommendations, and related features.
The Service may include plant and habitat recommendations, educational content and biodiversity tools, user profiles and photo sharing, optional public profiles for individuals and organizations, biodiversity insights and scoring features, and communications via email, push notifications, or SMS verification.
Wildr may update, modify, or discontinue parts of the Service at any time.
2. Eligibility
You must be at least 18 years old to use Wildr. By using the Service, you represent that you are at least 18 years old, have the legal capacity to agree to these Terms, and will comply with applicable laws and regulations.
3. Accounts and Security
Certain features require creating an account. You agree to provide accurate and current information, maintain the confidentiality of your login credentials, and notify Wildr of unauthorized access to your account. You are responsible for all activity under your account. You may delete your account at any time. Wildr may suspend or terminate accounts at its discretion.
4. Nature of Recommendations (Important Disclaimer)
Wildr provides general informational recommendations related to plants, biodiversity, and habitat management. Wildr does not provide landscaping or ecological consulting, fire safety or wildfire risk assessments, property or structural advice, or legal, environmental, or professional advice of any kind.
Recommendations may not account for local laws, HOA rules, or fire regulations, may involve plants that are toxic or hazardous in some contexts, and may not be appropriate for your specific property. You are solely responsible for evaluating and implementing recommendations. Your use of the Service is at your own risk.
5. User Profiles and Public Content
Profiles are private by default. Users may choose to make their profile public at their sole discretion.
Only if a user actively chooses to make their profile public may others view their name or handle, profile photo, habitat features, uploaded photos, general location (such as city or region), and Wildr score or related metrics (if applicable).
Street addresses and precise locations are never displayed publicly, regardless of profile visibility settings.
Public profiles may become searchable within the Wildr Service, but Wildr does not intend to make public profiles searchable by external search engines.
Users should avoid posting sensitive personal information. Wildr is not responsible for how other users interact with publicly shared content.
6. Organization Accounts
Organizations such as museums, zoos, botanical gardens, or institutions may request organization account status. Organization verification occurs through a request and approval process. Wildr may approve or deny organization accounts at its discretion. Users creating accounts for organizations represent they are authorized to act on behalf of that organization.
7. User Content
Users may upload photos, profile information, habitat features, and related content (“User Content”). Users retain ownership of their content.
By uploading content, you grant Wildr a worldwide, non-exclusive, royalty-free license to host and store the content, display the content within the Service, process and analyze the content to operate and improve the Service, develop automated tools, recommendation systems, or recognition features, and generate anonymized and aggregated biodiversity insights and statistics.
Wildr will not sell your photos or personal content. Wildr will ask for your permission before using your content for marketing or promotional materials. You represent that you have the right to upload all content you submit. Wildr may remove content that violates these Terms.
8. Content Moderation and Reporting
Wildr strives to maintain a safe and respectful platform. Users may report content they believe violates these Terms or community standards using the reporting tools available within the Service.
Wildr staff may review and remove content that is inappropriate or abusive, illegal or harmful, infringing on intellectual property rights, or misleading or impersonating others. Wildr reserves the right to remove content or suspend accounts at its discretion.
9. Acceptable Use
You agree not to use the Service unlawfully, upload harmful or malicious content, impersonate individuals or organizations, infringe intellectual property rights, or interfere with other users or the Service. Wildr may suspend or terminate accounts that violate these Terms.
10. Third-Party Services
Wildr may integrate with third-party services or scientific data sources. Wildr is not responsible for the accuracy, availability, or practices of third-party services.
11. Communications
By using the Service you agree to receive account and service emails, push notifications, and SMS messages for login or verification if enabled. Wildr will only send SMS marketing messages if a user explicitly opts in. You may unsubscribe from marketing emails at any time.
12. Intellectual Property
All Service content (excluding User Content) is owned by Wildr or its licensors and protected by intellectual property laws.
13. Disclaimer of Warranties
The Service is provided “as is” and “as available.” Wildr makes no warranties regarding accuracy of recommendations, reliability of the Service, or environmental or biodiversity outcomes.
14. Limitation of Liability
To the fullest extent permitted by law, Wildr is not liable for property damage, environmental or wildfire outcomes, plant toxicity or hazards, loss of data or use, or indirect or consequential damages. Wildr’s total liability shall not exceed $100 USD.
15. Indemnification
You agree to indemnify Wildr from claims arising from your use of the Service, your User Content, or your violation of these Terms.
16. Termination
Users may stop using the Service at any time. Wildr may suspend or terminate accounts at its discretion.
17. Changes to Terms
Wildr may update these Terms periodically. Continued use of the Service after changes means acceptance of the updated Terms.
18. California Users
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA). Please refer to the California Privacy Rights section of our Privacy Policy for details.
19. Governing Law
These Terms are governed by the laws of the State of New York. Any disputes shall be resolved in courts located in New York County, New York.
